Terms of Use – Phone & Text Communications
Lexicon Real Estate Management, LLC d/b/a Maple Leaf Apartments
Effective Date: October 13, 2025
These Terms of Use (“Terms”) govern your participation in our phone and text messaging communications program operated by Lexicon Real Estate Management, LLC d/b/a Maple Leaf Apartments (“Maple Leaf Apartments,” “we,” “us,” or “our”). By providing your phone number, interacting with our calls or texts, or otherwise using our services, you agree to these Terms.
Your consent to receive automated calls or texts is not a condition of renting or receiving services. You may transact with us through non-telephone channels at any time.
1. Program Description
We communicate via voice calls and SMS/MMS text messages about our properties and services, including:
- Operational/account notices (e.g., maintenance updates, appointment confirmations, payment or account reminders, urgent community alerts);
- Community news and events; and
- Optional marketing/promotional messages (subject to your preferences).
Message/call frequency varies. Message and data rates may apply.
2. Enrollment & Consent (TCPA/E-SIGN)
By providing your phone number and opting in (online, in writing, verbally, or via text flow), you authorize us and our service providers to contact you at that number using any dialing or messaging technology, which may include automatic telephone dialing systems, prerecorded/artificial-voice messages, and automated text messaging systems, as permitted by law.
- You represent you are the current subscriber or have the authority of the subscriber for the number provided.
- You agree that electronic records and signatures (including web/app checkboxes, typed names, and text opt-ins) satisfy legal requirements for written consent.
If your number changes or is reassigned, you agree to notify us promptly and re-enroll if desired.
3. Opt-Out & Help (Calls and Texts)
- Texts: Reply STOP to cancel further texts from that program line. You may receive a final confirmation message.
- Calls: Tell our agent you wish to opt out, or if prompted during automated/prerecorded calls, follow the automated instructions to opt out.
- Help: Text HELP for assistance or contact us using Section 13.
- You can also email or call us (Section 13) to revoke consent for some or all automated calls/texts. Your preferences will be honored within a reasonable time.
We will continue to place non-marketing, service/transactional calls or texts as permitted by law (e.g., safety or emergency notices), even if you opt out of marketing.
4. Calling Windows; DNC Compliance
We endeavor to place non-emergency marketing calls only between 8:00 a.m. and 9:00 p.m. local time (as recognized by your number) and to honor federal/state “Do Not Call” lists and our internal DNC list. You can request placement on our internal DNC list at any time.
5. Carrier & Delivery Disclosures
For text messages, wireless carriers are not liable for delayed or undelivered messages. Delivery of calls or texts depends on your phone carrier/network. Supported carriers may change without notice.
6. Acceptable Use
You agree not to use our phone/text channels to transmit unlawful, harassing, defamatory, abusive, or fraudulent content; to infringe others’ rights; to interfere with program operation/security; or to spoof or misrepresent identity. We may suspend or terminate access for suspected violations.
7. Privacy
We use your information to operate and improve our phone/text communications and related resident services. See our Privacy Policy for details, including data sharing, security, and retention practices.
8. Program Changes; Suspension
We may modify or discontinue the phone/text program (in whole or part) at any time. If we make material changes to these Terms, we will provide notice (e.g., by call, text, or website). Your continued participation after changes take effect constitutes acceptance of the updated Terms. We may suspend or terminate your access for non-compliance, network abuse, or legal/compliance considerations.
9. Disclaimers
The phone/text program is provided on an “as is” and “as available” basis. To the fullest extent permitted by Illinois law, we disclaim all warranties (express, implied, statutory), including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free calling or messaging.
10. Limitation of Liability
To the fullest extent permitted by Illinois law, Maple Leaf Apartments and its owners, officers, employees, agents, and vendors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, goodwill, or business, arising out of or related to the phone/text program or these Terms. Our aggregate liability will not exceed $100 or the amount you paid (if any) for the program in the twelve months preceding the claim, whichever is greater.
11. Eligibility & Account Responsibilities
You must be at least 18 years old (or the age of majority in your jurisdiction). You are responsible for keeping your contact information current and securing your device. You are responsible for activity initiated from your enrolled number.
12. CTIA & TCPA Compliance
We endeavor to comply with applicable CTIA guidelines and the Telephone Consumer Protection Act (TCPA) and related rules. To report concerns, contact us using Section 13. Consent to automated calls/texts is not a condition of renting or receiving services.

14. Governing Law; Venue
These Terms are governed by the laws of the State of Illinois. Exclusive venue lies in the state courts of Will County, Illinois (and, where federal jurisdiction exists, the U.S. District Court for the Northern District of Illinois).
15. Severability; Entire Agreement
If any provision is held unenforceable, the remaining provisions remain in full force. These Terms constitute the entire agreement regarding the phone/text program and supersede prior or contemporaneous communications on this subject.
